Apple’s Victory Allows ‘Fortnite’ Back on U.S. iOS App Store After Court Ruling Against Apple in Epic Games Case

Epic Games’ juggernaut title “Fortnite” is heading back to the iOS App Store in the United States.

According to court documents obtained and reviewed by

, a District Court in California found that Apple willfully violated the court order in the
Epic Games v. Apple suit
. “For the reasons set forth herein, the Court finds Apple in willful violation of this Court’s 2021 Injunction which issued to restrain and prohibit Apple’s anticompetitive conduct and anticompetitive pricing. Apple’s continued attempts to interfere with competition will not be tolerated,” Judge Yvonne Gonzalez Rogers said in the documents.

Epic’s
lawsuit
against Apple argued that the tech company acts as a monopoly,
taking a 30% cut on all in-app purchases
while banning outside payment methods.

The document states, ‘This is an injunction, not a negotiation. Once a party deliberately ignores a court order, there are no second chances.’ It adds, ‘Timing is crucial. Further delays will not be accepted by the Court. As has been mandated before, Apple must refrain from hindering competition. Consequently, Apple is prohibited from engaging in additional anti-competitive actions aimed at circumventing this injunction. Starting now, Apple can no longer obstruct developers’ communication with their customers, and they are forbidden from charging or imposing a new fee for transactions made outside the app.’

Rogers’ submission additionally stated that Apple’s Vice President of Finance, Alex Roman, “deliberately misled” the court under oath: “This directly contradicts Apple’s original statements made during the trial. Internal company records show that Apple was fully aware of its actions and consistently opted for the least competitive choice available.”

In August 2020, Apple announced official
kicked “Fortnite” and other Epic Games titles out of the App Store
, suspending the gaming company’s development account following Epic’s antitrust lawsuit against the technology corporation.

Epic Games founder and CEO Tim Sweeney responded to the court’s findings in a series of posts on X. “NO FEES on web transactions. Game over for the Apple Tax. Apple’s 15-30% junk fees are now just as dead here in the United States of America as they are in Europe under the Digital Markets Act. Unlawful here, unlawful there,” he wrote.

In a different posting, Sweeney stated, “Next week, ‘Fortnite’ will come back to the US iOS App Store,” yet he noted that significant tasks remain for global implementation. Epic proposes a truce: Should Apple extend the court’s zero-friction, tax-free structure globally, they would reintroduce ‘Fortnite’ into the App Store internationally and cease all ongoing and future legal actions regarding this matter.

During a media call on Wednesday night, Sweeney expanded on the court’s ruling, stating, “This marks a significant win for developers. It allows them to provide Apple’s payment system alongside their own without being compelled to pay fees for using alternative methods. Consequently, developers have the option to share cost savings with consumers via tiered pricing.”

What this accomplishes is making Apple compete with other payment systems instead of prohibiting them,” Sweeney went on. “This is exactly what we were aiming for. We have consistently recognized Apple’s authority to run their own app store and manage their own payment system. Our objective has been to establish an even playing field where developers can vie against Apple to provide their own offerings, allowing consumers to freely select the superior one, ensuring that the best product prevails.”

Sweeney also commented on ‘Fortnite’s’ playful “Tart Tycoon” outfit from 2020, which portrays a threatening businessman with an apple-like head. He mentioned that this Tart Tycoon outfit in Fortnite represented Apple blocking ‘Fortnite’. They provided it as a complimentary item during the #FreeFortnite cup. However, few were aware that they actually created two distinct outfits back then. The second one was crafted under the assumption that Epic Games and Apple could reconcile and come to terms. This alternate outfit aligns more closely with what iOS gamers might enjoy.
